Spens is an online retailer providing fresh vegetables, fruit, pantry essentials, and related food products within South Africa.

2. Eligibility

You have the legal capacity to enter into a binding agreement.

3. Product Availability

Our products are subject to availability.

Because we work with fresh produce:

Stock levels may change daily.
Some products may be substituted with similar items where appropriate.
If a product becomes unavailable after payment, we will contact you regarding a replacement or refund.

4. Product Images

We do our best to display products accurately.

Please note:

Images are for illustration purposes.
Fresh produce naturally varies in size, colour and appearance.
Actual products may differ slightly from the photographs.

5. Pricing

All prices are displayed in South African Rand (ZAR).

Prices:

include VAT where applicable
may change without notice
are confirmed at checkout.

Obvious pricing errors may be corrected before orders are processed.

6. Orders

Submitting an order does not automatically mean it has been accepted.

Spens reserves the right to:

decline an order
limit quantities
cancel suspicious or fraudulent orders
refuse service where necessary.

7. Payment

We accept payment through secure third-party payment providers.

Payment must be received before an order is processed.

Spens does not store your banking or card details.

8. Delivery

Delivery areas and delivery fees are shown during checkout.

Delivery times are estimates only.

Factors beyond our control such as:

traffic
weather
supplier delays
power outages

may affect delivery times.

9. Customer Responsibilities

Customers are responsible for:

providing the correct delivery address
ensuring someone is available to receive the order
inspecting the order upon delivery.

If nobody is available to receive the delivery, additional delivery charges may apply.

10. Fresh Produce

Fresh produce is perishable.

Although we take every precaution to maintain quality, customers should:

refrigerate products where necessary
consume products within recommended timeframes
inspect products upon delivery.

11. Returns & Refunds

Due to the nature of fresh food:

We cannot accept returns of fresh produce unless:

the item was damaged
spoiled upon delivery
incorrectly supplied.

Any concerns should be reported within 24 hours of delivery with clear photographs where possible.

Approved refunds or replacements will be processed at our discretion in accordance with the Consumer Protection Act.

12. Order Cancellation

Orders may be cancelled before dispatch.

Once an order has been packed or dispatched, cancellation may no longer be possible.

13. Promotions

Promotions, discounts and voucher codes:

are subject to availability
may not be combined unless stated
may be withdrawn at any time.

14. Website Use

You agree not to:

misuse the website
interfere with website security
upload malicious software
copy website content without permission
use the website for unlawful purposes.

15. Intellectual Property

All website content including:

logos
branding
photographs
graphics
product descriptions
text

belongs to Spens unless otherwise stated.

No content may be copied without written permission.

16. Limitation of Liability

To the maximum extent permitted by law, Spens shall not be liable for indirect, incidental or consequential losses arising from the use of our website or products.

Nothing in these Terms excludes rights that customers have under South African law.
